Update On The UVA Alleged Hazing Lawsuit

In the ongoing civil lawsuit involving five former University of Virginia men’s swim team members being accused of hazing by former teammate Anthony Marcantonio, The Daily Progress reports that attorneys for the plaintiff have responded to the defendants’ motions to dismiss the case.

Earlier this month, Kyle Dudzinski, Luke Papendick, Charles Rommel, David Ingraham and Jacob Pearce asked that the case be dismissed from federal court due to failure for the plaintiff to ‘state claims which relief could be granted’, as well as the plaintiff’s failure ‘to provide sufficient facts for most, if not all, of the 10 counts he asserts against them.’ The defendants maintain that the alleged hazing activities (of which you can read more details here), were harmless and Marcantonio could have opted out at any time.

Now, in a memorandum filed this week, Marcantonio’s attorney opposes such dismissal motions, saying that “in the light most favorable to [Marcantonio] and accepting the factual allegations as true, as the law requires, each count states a claim.” Marcantonio’s side argues that what occurred “was far from the benign events characterized by the defendant as a ‘team bonding event’ and the defendants’ motions for dismissal should be denied.
